Order On Board
02/03/2026
1. Heard on IA No.01/2025, application for condonation of delay in filing the present MCC.
2. The present MCC has been filed for restoration of SA No.531/1999, which was dismissed for want of prosecution on 2.5.2014.
3. As per the office note dated 26.2.2026, there is delay of 4191 days in preferring the MCC.
4. It is stated in the application for condonation of delay that the present applicants came to know about the order dated 2.5.2014 only on 15.1.2025 when they received the notice dated 6.1.2025 from the
4 Executing Court, Jagdalpur. It is also stated that the order dated 2.5.2014 was never communicated by the concerned Advocate. For all such reasons, the present MCC could not be preferred on time.
5. After hearing learned counsel for the applicants and after going through the records, this Court is of the considered opinion that the explanation offered for condonation of delay of 4191 days in preferring this MCC is not sufficient and the same cannot be accepted. Accordingly, IA No.1/2025, application for condonation of delay deserves to be and is hereby rejected.
6. Consequently, the present MCC also stands dismissed.
