1. The present writ petition has been filed seeking a direction to the respondent-MCD to take action against the unauthorized construction at agricultural land located Behind Farm House No.A-2 & A-3, in Khasra No.133, Asola Village, Fatehpur Beri, New Delhi-110074 (‘subject property’). 2. The grievance of the petitioner is that the private respondent no.4 is carrying out unauthorized construction on the subject property, which is adjoining his property, in the shape of a commercial shed, without any This is a digitally signed order. Mr. Kapil Dutta, standing counsel for the respondent-MCD appears on advance notice and submits that demolition action has already been carried out on 19th August against the unauthorized structures created by the private respondent no.4. 3.1 Photographs showing the demolition action have been handed over in Court and the same are taken on record. 4. Mr. Dutta has also handed over a communication dated 27th August, 2026 to SHO, P.S. Maidan Garhi, wherein the police authorities have been asked to keep strict vigil on the subject property so that the owner/occupier does not reconstruct or restore the demolished portion. 4.1 The said communication is also taken on record. 5. In view of the aforesaid, the present writ petition is disposed of directing the respondent-MCD to take appropriate action in accordance with law. 6. All rights, contentions and legal remedies of the private respondent shall remain protected. 7. Pending application stands disposed of.
