Learned counsel for the petitioner files a memo seeking to withdraw the present Writ Petition.

Learned counsel for the respondent vehemently opposes the same.
3. It is contended by the learned counsel for the respondent that the order impugned in the present Writ Petition was for grant of custody of the child from 04.05.2026 till 17.05.2026. It is further submitted that the petitioner by abusing the process of this Court has filed the present petition and kept the same pending till date so

as not to comply with the impugned order. It is further contended that having regard to the present Writ Petition, the respondent has lost an opportunity of visitation right which was granted by virtue of the impugned order.
4. Having regard to the fact that the petitioner is seeking to withdraw the present petition, no orders can be passed with regard to the apprehension expressed by the respondent.
5. However all the rights and contentions of both the parties are kept open to be availed in appropriate proceedings.
6. The Writ Petition is disposed of with the aforementioned observations.
