Learned counsel for the petitioner submits that the petitioner is in custody in connection with Radhanagar P.S. Case No. 106/2026 for the offence registered under Section 87, 96, 351(2), 3(5) of BNS, now said to have been pending in the court of learned Judicial Magistrate 1st Class, Rajmahal.

Learned counsel for the petitioner submits that the petitioner is in custody since 08.04.2026 and charge-sheet has already been submitted. The learned counsel submits that during the course of investigation and even as per the statement of the victim recorded in the case diary, she was having a love affair with the petitioner and had eloped with him. The
learned counsel has further submitted that although in the impugned order dated 22.05.2026, it has been mentioned that the victim was recovered from the house of the petitioner, but that observation has been modified vide order dated 01.06.2026 and as per the case-diary, the victim was not recovered from the house of the petitioner.

Learned counsel for the opposite party has opposed the prayer for bail and has submitted that the victim was 17 years of age and therefore the petitioner may not be enlarged on bail.
4. To this, the learned counsel for the petitioner has submitted that the petitioner is 22 years of age.

After hearing the learned counsel for the parties and upon perusal of the case-diary, it appears that there has been some element of love affair between the petitioner and the victim and in view of the fact that charge- sheet has already been submitted, the petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Rs. Twenty-Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Rajmahal in connection with Radhanagar P.S. Case No. 106/2026, subject to the following conditions: - (i) One of the bailors would be the present pairvikar of the petitioner. (ii) The other bailor should be his close relative. (iii) The petitioner will attend the court on each and every date and on account of his single default, the learned court shall cancel the bail bond furnished by the petitioner. (iv) The petitioner would deposit a self-attested copy of his Aadhar Card along with his Mobile Number before the learned court below, which he shall not change during the pendency of the case without prior permission of the court. (v) The petitioner shall fully co-operate with the proceedings before the learned court below.
6. The instant bail application is allowed with the aforesaid conditions.
7. Let a copy of this order along with a copy of the affidavit filed with the bail petition be communicated to the court concerned through ‘e- mail/FAX’.
