Heard Sri Vijay Gautam, learned Senior Counsel assisted by Ms. Arya Gautam, Ms. Atipriya Gautam and Sri Pratyush Srivastava, learned counsel for the petitioner and learned Standing Counsel for the respondents-State. 2. The order dated 21.11.2025 passed by the respondent No.2/Commissioner of Police, Ghaziabad, Police Commissionerate Ghaziabad is under challenge in the present petition. 3. It is argued by Sri Vijay Gautam, learned Senior Counsel that the order impugned is bad in the eyes of law in view of the judgement rendered by this Court in the case of Sachichida Nand Tripathi Vs. State of U.P. and 2 others (Writ A No.69308 of 2013) decided on 17.12.2013. It is argued that following the aforesaid judgement, large number of order had been passed by this Court from time to time and as such one of the order is appended at Page 64 of the writ petition being Writ A No.3481 of 2026 decided on 23.03.2026. 4. The legal position placed before this Court by learned Senior Counsel has not been disputed by learned Standing Counsel. 5. Accordingly and following the reasons assigned in the case of Sachchida Nand Tripathi (Supra) the instant writ petition is allowed. The impugned order dated 21st November, 2025 is hereby quashed. This order however shall not preclude the respondents from initiating fresh proceedings in accordance with law and the provisions made in the Uttar Pradesh Police Versus Counsel for Petitioner(s) : Arya Gautam, Atipriya Gautam, Sr. Advocate, Vaishnavi Srivastava Counsel for Respondent(s) : C.S.C.
