1. SAMANTHA KRISHNA SRIRAMAKAVACHAM Counsel for the Respondent(S):
1. The Court made the following:
THE HONOURABLE SRI JUSTICE RAVI NATH TILHARI CIVIL REVISION PETITION NO: 723/2026
ORDER:-
The suit O.S.No.874 of 2019 filed by the plaintiff-respondent No.2 against respondent No.1 (defendant) was decreed vide decree dated 09.02.2026 passed by the Principal Civil Judge (Junior Division), Visakhapatnam.
2. It appears that in the said suit the present petitioner filed I.A.Gr.No.1293 of 2026 for his impleadment under Order 1 Rule 10 CPC which was returned vide endorsement dated 06.02.2026.
3. This Court is of the considered view that against the endorsement dated 06.02.2026 of the return of the application at the stage of GR in the suit, which has been decided finally on 09.02.2026, the present CRP after the decision in the suit is not maintainable.
4.
Learned counsel for the petitioner submits that the grievance is with respect to the decree dated 09.02.2026 in the suit.
5. Even if it be so, then the remedy is not by way of CRP under Article 227 of Constitution of India. If a non-party to the suit is aggrieved from the decree, the remedy lies elsewhere, may be to file an appeal with the leave of the appellate Court.
6. The Civil Revision Petition is not maintainable and is dismissed.
No order as to costs.
As a sequel thereto, miscellaneous petitions, if any pending, shall also stand closed. ___________________ RAVI NATH TILHARI,J
