4. The present writ petition as been filed by Indian Bank, which is the owner of the property bearing no. 3, M Block, Green Park, New Delhi –
110016. The said property is used for the residence as well as transit facilities for the officers of the bank. 5. The grievance of the petitioner is with regard to the demolition being carried out using heavy machinery in the neighbouring property bearing no. 2, M Block, Green Park, New Delhi (‘subject property’), which has resulted in damage to the property of the petitioner. 6. Photographs have been filed along with the present writ petition to show the cracks which have occurred on the petitioner’s property as well as the collapse of the boundary wall of the petitioner and other damage caused to the petitioner’s property. 7. Counsel appearing on behalf of respondent-MCD on advance notice submits that the demolition is being carried out pursuant to the order passed by the Appellate Tribunal, MCD (‘ATMCD’) on 20th January, 2026 in Appeal Nos. 92/20, 127/20 and 260/20, whereby appeal filed by the owners of the subject property, i.e. Jairaj Developers LLP, was dismissed.
7.1 Copy of the said order has been handed over in Court and the same is taken on record. 8. In terms of the aforesaid order, the owners of the property were given three (3) months’ time to demolish the property and a direction was issued to MCD to de-seal the said property for this purpose. 9. Counsel appearing on behalf of respondent-MCD submits that a demolition exercise has not been carried out within the aforesaid time period This is a digitally signed order. W.P.(C) 13258/2026 and hence, MCD is taking steps to re-seal the subject property. 10. Mr. Arun Vohra, counsel appearing on behalf of respondents no.5 and 6, i.e. the builders, submits that they have already applied for permission with the MCD for extending the period of de-sealing so that entire demolition exercise can be carried out. 11. Mr. Vohra submits that respondents no.5 and 6 shall promptly carry out all remedial/repair work at their own cost to remedy the damage caused to the property of the petitioner. 12. Mr. Vohra further submits that any further demolition work shall be carried out in a manner so as not to cause any damage to the petitioner’s property. He submits that no fresh construction, including excavation shall be carried out without obtaining a sanctioned plan from the respondent- MCD. 13. Taking the aforesaid submission on record and binding the private respondents no.5 and 6 to the same, the present writ petition is disposed of in the above terms. 14. In the event the petitioner has any further grievance with regard to unauthorised construction, the petitioner would be at liberty to take appropriate remedies in accordance with law. 15.
