1. By virtue of the present petition under Articles 226 and 227 of the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS), the petitioner seeks the following reliefs:-
“a. Pass an appropriate Writ, Order, and/or an appropriate direction thereby quashing the application dated 13.01.2025 filed by Respondent No. 2 under Section 156(3) read with Section 173(8) Cr.P.C. in Cr. Case No. 7027/2017, titled State v. Satish Julka & Ors., arising out of FIR No. 84/2010, P.S. Crime Branch, insofar as it seeks further investigation qua the Petitioner; This is a digitally signed order. b. Pass an appropriate Writ, Order, and/or an appropriate direction thereby directing Ms. Neha Priya, Ld. Chief Judicial Magistrate, South-West District, Dwarka Courts, New Delhi Court to expeditiously take up and hear
arguments on charge qua the Petitioner and pass an appropriate order thereon within such time as may be fixed by this Hon'ble Court, without granting unnecessary adjournments to either party; c. Pass such other or further order(s) as this Hon'ble Court may deem fit and proper in the facts and circumstances of the present case.”

After some arguments, learned counsel for the petitioner seeks to withdraw the present petition with liberty to seek appropriate remedies in accordance with law for disposal of the proceedings before the learned JMFC arising out of the FIR No.84/2010 registered at PS.: Crime Branch in a time bound manner, particularly, since the same are pending for the last sixteen years.
3. In such a situation, as also considering the lapse of time period of sixteen years, learned JMFC is requested to take a sympathetic view and try to make an earnest endeavour to dispose of the said proceedings arising from the said FIR No.84/2010 registered at PS.: Crime Branch as expeditiously as possible, albeit, considering its own timeline as also the list of pending cases before it.
4. Needless to mention, the learned JMFC shall also proceed in accordance with law.
5. As such, the present petition is dismissed as withdrawn with liberty as prayed for.
