POONACHA ORAL ORDER The present writ petition is filed seeking for the following reliefs: a) Issue a writ of Certiorari or any other appropriate writ, order or direction, quashing the endorsem,ent dated 01.04.2026 bearing No.BCP/J3/015/2026 issued by Respomndent No.2, produced as Annexure-A; b) Issue a writ of Mandamus or any other appropriate writ, order or direction, directing the Respondents to grant parole/emergency parole to the Petitioner's husband, Sri.Yogeesha (CTP No.14063), who is presently lodged in Central Prison, Parappana Agrahara, Bengaluru, for a period of 90 days (or such period as this Hon'ble Court deems fit), in view of the serious medical condition of the petitioner; - 3 - HC-KAR NC: 2026:KHC:25246 WP No. 12284 of 2026 c) Pass such opther orders as this Hon'ble Court deems fit in the facts and circumstances of the case, in the interest of justice and equity. 2. It is the case of the petitioner that he is a convicted prisoner having completed an imprisonment of 3 years, 1 month and 15 days. The petitioner sought for grant of emergency parole due to the medical treatment of his wife, who is stated to require immediate surgery. The 2nd respondent has rejected the parole by stating that the petitioner's life could also be in danger. However, it is expedient that emergency parole be granted for a period of fifteen (15) days. Hence, the following: ORDER (i) Writ petition is allowed. (ii) The 2nd respondent is directed to grant emergency parole to the petitioner for a period of 15 days subject to the terms as contemplated under the Karnataka - 4 - HC-KAR NC: 2026:KHC:25246 WP No. 12284 of 2026 prisons and Correctional Services Manual, 2021, upon receipt of the copy of this order. (iii) The 2nd respondent shall, amongst other conditions, stipulate that the petitioner shall mark his attendance every alternate day with jurisdictional police station, in the morning, at a scheduled time.
