The Petitioner - Zakir Hussain, who is claiming to be the son of Late Ms. Julie and Mr. Bindu Khan, has filed the present petition seeking transfer of the provisional Certificate of Vending (hereinafter “CoV”) in his favour. The mother of the Petitioner was issued a provisional CoV bearing No. Vendor ID: V2025601909 under the category of ‘Readymade Products’ and area of vending as Sarojni Nagar. 3. The Petitioner’s mother unfortunately passed away on 26th May, 2026. The copy of the death certificate has been placed on record. 4. The case of the Petitioner is that the father of the Petitioner has given a No Objection Certificate in his favour as he is 76 years of age and he has no objection if the vending site is transferred to the Petitioner. 5. The prayer of the Petitioner therefore is for transfer of the said vending certificate in his favour. This is a digitally signed order. Counsel appearing on behalf of the Respondent submits that the matter has to be verified as there could be other siblings of the Petitioner. 7. In any event, the case for transfer of CoV has to be considered by the Town Vending Committee (hereinafter ‘the TVC’) after it is constituted. 8. Heard, ld. Counsels for the parties. The Petitioner’s mother having passed away, the Petitioner has already made a representation dated 17th August, 2026 seeking transfer of CoV in his name. The elections of the TVC are to be held and the said issue is being monitored by this Court in other pending matters. 9. Accordingly, the issue of transfer of CoV would have to be considered by TVC-II after the elections are held and the same is constituted. 10. Accordingly, let the representation of the Petitioner be considered by the TVC-II within three months after it is constituted. The TVC may seek any documents, which may be required from the Petitioner in order to consider the said representation. 11. In the meantime, the Petitioner shall fully adhere to the terms and conditions of the provisional CoV and subject to the same, his vending shall not be disturbed. 12.
