The Petitioner is seeking bail in FIR No. 84/2026 dated 3rd of April, 2026 of Police Station, Budgam which culminated into final report No. 68/2026 under Sections 64 and 137 (2) of the Bharatiya Nyaya Sanhita (BNS), 2023 and Sections 3, 4, and 17 of the Protection of Children from Sexual Offences (POCSO) Act. 02. Indisputably, after registration of the aforesaid FIR, investigation into the matter was carried out and, on culmination of the investigation, Challan is presented before the POCSO Court at Srinagar. It is also not in dispute that the Petitioner, without approaching the Trial Court, straightway invoked the jurisdiction of this Court without any plausible reason. Therefore, this Court is not inclined to entertain this Petition, however, at this stage, the learned Counsel for the Petitioner seeks liberty to approach the Trial Court so as to avail the appropriate remedy. 03. In view of the submissions made by the learned Counsel for the Petitioner, this Petition is disposed of with the liberty to the Petitioner to approach the learned Trial Court, so as to avail appropriate remedy as provided under law. It goes without saying that the learned Trial Court shall consider the application, if any, filed by the Petitioner in accordance with law with due dispatch. 04. Disposed of.
