The accused/applicant has moved this First bail application under Section 483 of BNSS, 2023 for releasing him on regular bail during trial in connection with Crime No. 135/2025 registered at Police Station – Somini, District – Rajnandgaon (C.G.) for the offence punishable under Section 103 of the BNS. 2. The prosecution case, in brief, is that the deceased, Chandan Kumar Adka, and the present applicant, were employed as
2 daily-wage labourers at Kalyani Spat. On 15/06/2025, a dispute arose at the workplace when the deceased admonished the applicant for an error. Later that evening, both individuals consumed alcohol together and the earlier dispute resurfaced, leading to a heated argument between them. The applicant thereafter returned to his residence alone. At about 8:30 PM, the deceased approached the applicant's residence and began hurling abuses at him. Provoked by this, the accused Bhishmadev Singha, armed with a wooden bat assault the deceased and as a result of which, the deceased sustained critical injuries, was hospitalized and succumbed to his injuries during treatment. Based on this, an FIR was lodged and a charge-sheet has been filed against the applicant. 3. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in the crime in question. It is further submitted that the entire prosecution case rests on circumstantial evidence, and the eyewitness, memorandum witness, and seizure witness have turned hostile and have not stated anything against the applicant. The applicant has no criminal antecedents and has been in jail since
19.06.2025. Given that the trial is likely to take considerable time to conclude, the applicant may be released on bail. 4.
On the other hand, the learned counsel for the State opposes the bail application, submitting that a wooden stick (
लकड़ी क बट्टा) has been seized from the possession of the present applicant. She next submits that the FLS report is awaited and only 6 out
3 of 20 witnesses have been examined till date, and several important witnesses remain to be examined. Therefore, at this stage, the applicant should not be enlarged on bail. 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the facts and circumstances of the case, the nature and gravity of the offence, the material collected and available on record against the applicant and the fact that out of 20 witnesses, only 06 have been examined till date and and some important witnesses are still remaining for examination, at this stage, I am not inclined to release the applicant on bail. 7. Accordingly, the bail application filed under Section 483 of BNSS, 2023 is rejected. 8. However, considering the fact that the applicant is in jail since 19.06.2025 i.e., about 08 months 13 days. It is an exceptional case, therefore, concerned trial Court is directed to expedite the trial as early as possible preferably within a period of 04 months from the date of receipt of copy of this order. 9.
