The instant Civil Miscellaneous Petition has been filed for restoration of writ petition being W.P.(C) No.4775 of 2013 which stood dismissed on 01.11.2022 due to non- compliance of the peremptory order dated 12.10.2022. 2. The reason assigned in the instant petition is that the counsel for the petitioner was not having knowledge about the said defect and thereby, the defect as pointed out by the office could not have been removed, and hence, the peremptory order could not have been complied. 3. It has been submitted that the instant Civil Miscellaneous Petition has been filed for restoration of writ [2026:JHHC:18543] 2 petition being W.P.(C) No.4775 of 2013 and if the same will not be restored, the petitioner will suffer irreparable loss and injury. 4. None is present to represent the opposite parties. 5. This Court, after having heard the learned counsel for the petitioner, considering the submissions advanced by him and the reason assigned in the instant Civil Miscellaneous Petition, is of the view that the instant petition is to be allowed otherwise the petitioner will suffer irreparable loss and injury since the matter would not be decided on merit. 6. Considering the same, this Court deems it fit and proper to restore the writ petition being W.P.(C) No.4775 of 2013 which stood dismissed on 01.11.2022 due to non- compliance of the peremptory order dated 12.10.2022, to its original file. 7. In view thereof, the writ petition being W.P.(C) No.4775 of 2013 is restored to its original file subject to removal of defect(s) within a period of two weeks from today. 8.
