JUSTICE S.R.KRISHNA KUMAR ORAL ORDER Petitioner is before this Court seeks quashing of the impugned Endorsement at Annexure-A dated 03.03.2026 rejecting the request of emergency parole application filed on behalf of the petitioner’s husband – Sri. S. Rajesh, who is currently serving sentence at the Central Prison, Bangalore, as a life convict – CTP No.15080 in terms of the Prison Manual and for other reliefs. 2. Heard learned counsel appearing for the petitioner and learned AGA appearing for respondents and perused the material on record. 3. The material on record discloses that the petitioner’s husband – S. Rajesh (CTP No.15080), has been convicted and sentenced to undergo imprisonment for life in relation to the proceedings in S.C.No.144/2020 vide judgment dated 25.01.2025 and the petitioner seeks parole on behalf of her husband on the humanitarian ground that she has various ailments and disease requiring medical treatment and the request of the petitioner’s husband for parole having been rejected by the 2nd respondent vide - 3 - HC-KAR NC: 2026:KHC:24768 WP No. 13080 of 2026 impugned Endorsement dated 03.03.2026, petitioner is before this Court by way of the present petition. 4. I have given my anxious consideration to the rival contentions of both parties and perused the material on record. 5. The aforementioned facts are not in dispute and therefore, requires no reiteration. The petitioner seeks parole on behalf of her husband on the humanitarian ground that she has various ailments and disease requiring medical treatment. Therefore, I deem it appropriate to quash the impugned Endorsement at Annexure-A dated 03.03.2026 and grant the petitioner’s husband – S. Rajesh (CTP No.15080), an emergency parole for a period of fifteen days, which becomes operational from 19.05.2026 to 02.06.2026. 6. In the result, I pass the following:- ORDER (i) Petition is hereby allowed in part. (ii) Petitioner’s husband, the detenue – S. Rajesh (CTP No.15080) is granted emergency parole for a period of fifteen days which becomes operational from 19.05.2026 to 02.06.2026. - 4 - HC-KAR NC: 2026:KHC:24768 WP No. 13080 of 2026 (iii) The convict (CTP No.15080) - shall mark his attendance before the SHO of jurisdictional police station, weekly once throughout the period of his parole and it would be the responsibility of the jurisdictional police to take him to jail, in the event, the convict (CTP No.15080) would evade going back to the jail after the expiry of the period of emergency parole. (iv) Respondents shall stipulate strict conditions as are usually stipulated, to ensure return of the detenue to the jail and that the convict shall not commit any other offences during the period of parole.
