This is landlord’s petition, challenging the judgment and order passed by learned District Judge, Udham Singh Nagar in SCC Revision No. 33 of 2007. Petitioner has also challenged the judgment rendered by learned Small Causes Court in SCC Case No. 01 of 2004. 3. Learned Trial Court as well as learned Revisional Court had decided the case against the petitioner and held that he could not prove his allegation that tenant had materially altered the demised premises which had led to diminution of value of the property. 4. Learned counsel for the petitioner submits that he has been instructed by his client not to press this writ petitioner. He, therefore, submits that petitioner be permitted to withdraw the writ petition with liberty to petitioner to approach the appropriate forum for cause of action which may be available to him. 5.
