GP FOR MEDICAL HEALTH FW The Court made the following: 3 THE HON’BLE SRI JUSTICE VENKATESWARLU NIMMAGADDA WRIT PETITION NO.8625/2026 ORDER:- This writ petition is filed under Article 226 of the Constitution of the India seeking the following reliefs:- “to issue Writ of Mandamus or any other appropriate Writ, Order or direction directing respondent No.2 to cancel the Petitioner’s PCI Registration Certificate forthwith and issue the necessary Cancellation Certificate/ NOC, consequently direct the respondents to facilitate the Petitioner’s ability to enroll in the Bar Council of Andhra Pradesh without further delay, ensuring she can meet the statutory deadlines for her legal practice and to pass such other order or orders….” 2. Heard learned counsel for the petitioner, learned Government Pleader for the respondent No.1 and Sri M.Venkateswara Rao, learned Standing Counsel for respondent No.2. 3. The case of the petitioner herein is that the petitioner submitted an online application to the respondent No.2 seeking for cancellation of her professional pharmacy certificate issued in the year 2020 i.e., on 26.06.2020. The said registration of the petitioner was renewed on 29.03.2025 for a period of five years which is valid upto 31.12.2029. The further case of the petitioner is that the petitioner has been pursuing LLB course and now she is intended to enroll with the Bar Council of Andhra Pradesh as an advocate. For which, she submitted an application/representation on 24.02.2026 seeking for voluntary cancellation of her PCI (Pharmacy Council of India) Registration Certificate to the respondent No.2. But, even after lapse of more than 1½ 4 month, the respondent No.2 neither cancelled the certificate and intimated the same nor replied to the petitioner requesting for fulfillment of any queries. Hence, the writ petition. 4. On the other hand, Sri M.Venkateswara Rao, learned Standing Counsel for respondent No.2 furnished written instructions dated 06.04.2026, wherein, it is stated as under: “Andhra Pradesh Pharmacy Council will consider her application provided if she submits the application as per the procedure by enclosing all the required certificates and documents. If there are no violations as per Pharmacy Act, 1948 and Pharmacy Practice Regulations, 2015, the NOC will be issued U/R 83 of the Andhra Pradesh Pharmacy Council Rules, 1955. Procedure for voluntary cancellation Application: Candidate has to submit the application personally at AP Pharmacy Council, Vijayawada Office along with the following documents.  Original Registrartion Certificate: the Original Registration Certificate issued by the AP Pharmacy Council along with valid Renewal Certificate has to be enclosed.  Affidavit 1: A notarized affidavit stating the reason for voluntary cancellation.  Affidavit 2: A notarized affidavit with a declaration that no disciplinary or criminal proceedings are pending or likely to be taken.  Self Declaration form: Proforma available in the Council’s website.  Identification Proof: Aadhar Card  Photography: Recent passport size photography. 5  An undertaking not to practice pharmacy as long as B.L/ LL.B/ Nursing/ Paramedical professions are practiced. (Related qualification documents have to be enclosed). Verification: Verification of documents to comply APPC Rule 83 and also for confirmation that no violations took place as per pharmacy Act, 1945.” 5. Learned Standing Counsel for the respondents further submits that except stating that the petitioner has been submitted a representation, the petitioner neither filed any acknowledgment issued by the respondent No.2 nor furnished any evidence that the said representation was received by the respondent No.2. However, learned Standing Counsel for respondent No.2 submits that the respondent No.2 is ready to cancel the PCI Registration Certificate issued in favour of the petitioner subject to compliance of the submission of documents along with application under rule 83 of the Andhra Pradesh Pharmacy Council Rules, 1955 as enumerated in the written instructions. If the petitioner submitted an application as well as relevant documents complying with all the requirements as enumerated, the request of the petitioner would be considered as per the Rule 83 of the Andhra Pradesh Pharmacy Council Rules, 1955. 6. Having regard to the submissions made by both the learned counsel and on perusal of the material placed on record, without going into the merits of the case, this Court is of the considered view that the present writ petition can be disposed of, directing the petitioner to submit an application along with all the required documents as enumerated in the written instructions dated 6 06.04.2026 which is served upon the learned counsel for the petitioner across the bench, within a period of two (02) weeks from the date of receipt of a copy of this order. After such submission and compliance in all respects as per the instructions, the respondent No.2 is directed to consider the request of the petitioner, after verifying the documents submitted by the petitioner otherwise eligible and to issue certificate cancelling the original registration certificate of the petitioner by granting NOC as per rule 83 of the Andhra Pradesh Pharmacy Council Rules, 1955 within a period of four (04) weeks, thereafter. 7. With the above directions, the writ petition is disposed of. No costs.
