ARAVIND ORAL ORDER This petition is filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023, (for short, 'BNSS') by the accused for grant of bail in Crime No.42/2026 dated 10.02.2026 registered by the Electronic City Police Station, Bengaluru City for the offences punishable under Section 329(3), 351(3), 352, 74 and 75 of Bharatiya Nyaya Sanhita, 2023 (for short, 'BNS'). 2. The complaint came to be filed alleging threat, misbehaviour, and sending abusive messages to the complainant. The pleadings indicate that the complainant and the petitioner/accused have known each other for several years. It is further pleaded that the petitioner had undertaken renovation work of the complainant’s dental clinic and certain disputes had arisen with regard to completion of the said renovation work. - 3 - HC-KAR NC: 2026:KHC:24806 CRL.P No. 4180 of 2026 3. Learned counsel for the petitioner submits that the petitioner and the complainant were in a voluntary consensual relationship for several years and, owing to misunderstandings that arose in the said relationship, the present complaint has been filed. 4. Learned High Court Government Pleader appearing for the respondent-State submits that the petitioner had threatened the complainant with committing suicide and is likely to repeat the same if enlarged on bail. 5. Having considered the submissions made by the learned counsel for the petitioner and the learned HCGP, this Court is of the opinion that, prima facie, the petitioner and the complainant had entered into contractual arrangements in relation to renovation work of the dental clinic. Thereafter, owing to their proximity, they voluntarily entered into a relationship. Subsequently, on account of misunderstandings between them, the present complaint came to be filed. 6. At this stage, no impediment to the investigation would arise if the petitioner is enlarged on bail. There is also no - 4 - HC-KAR NC: 2026:KHC:24806 CRL.P No. 4180 of 2026 material to indicate that the petitioner would tamper with the evidence or threaten the witnesses. 7. In the light of the above, following: ORDER (i) The petition is allowed. (ii) The petitioner is ordered to be enlarged on bail in Crime No.42/2026 registered by the Electronic City Police Station for the offences punishable under Sections 329(3), 351(3), 352, 74, and 75 of the BNS, subject to the following conditions: a) The petitioner shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the like sum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly before the Trial Court on all dates of hearing unless exempted; c) The petitioner shall not, directly or indirectly, threaten or tamper with the prosecution witnesses; - 5 - HC-KAR NC: 2026:KHC:24806 CRL.P No. 4180 of 2026 d) The petitioner shall not involve himself in any offences in future.
