1. The Petitioner had earlier approached this Court in W.P.(C) 7245/2017, which was allowed vide judgment dated 18th May, 2026. Amongst other directions, the Court directed the Respondents to grant the Petitioner all retiral dues and consequential retirement benefits which would have been payable to him in accordance with law but for the punishment
order dated 30th July, 2009. Such benefits were specifically stated to include gratuity. The Court further directed that the amounts found payable would carry simple interest at the rate of 6% per annum from the date on which each amount became due until the date of actual payment. The relevant directions specified in paragraph 96 of the said judgment state as follows: This is a digitally signed order. “(iii) The Petitioner shall be entitled to all retiral dues and consequential retirement benefits which would have been payable to him in accordance with law but for the punishment order dated 30th July, 2009. Such benefits shall include gratuity, leave encashment, admissible post-retirement medical benefits and all other consequential benefits, if any, payable under the applicable rules. xxx…….xxx…….xxx (v) The Petitioner shall be entitled to simple interest at the rate of 6% per annum on the amounts found payable, calculated from the date on which each amount became due until the date of actual payment. In the event the amounts are not released within the period stipulated above, the outstanding amount shall thereafter carry interest at the rate of 9% per annum from the date of default until payment.”
2. The present petition has been instituted against Power Grid Corporation of India Ltd. (“PGCIL”), which was not a party to the earlier writ petition. The Petitioner seeks statutory interest on the gratuity pertaining to his service with PGCIL. The principal gratuity amount of INR 77,078/- has since been released to the Petitioner. The Petitioner, therefore, seeks payment of statutory interest on the delayed payment of the said gratuity. 3. The Court has heard counsel for the parties. Section 7(3A) of the Payment of Gratuity Act, 1972 mandates payment of simple interest on delayed payment of gratuity at the rate specified in accordance with the said provision. The Petitioner relies upon Notification No. S.O. 874(E) dated 1st October, 1987, specifying the rate of interest at 10% per annum.
In view of the statutory mandate and the admitted payment of the principal gratuity amount, the Respondent shall pay to the Petitioner simple interest at the rate of 10% per annum on INR 77,078/-, calculated from the date on which the gratuity became payable until the date of its actual payment. 4. PGCIL shall comply with the aforesaid direction within a period of two months from today. 5. The writ petition, along with the pending application, is disposed of in This is a digitally signed order.
