Heard the parties. The petitioner has been made accused in connection with Ahilyapur P.S. Case No.25 of 2025 registered for the offences punishable under Sections 140(1), 61(2) of the B.N.S., 2023.
Learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner abducted Dinesh Mandal in conspiracy with the co-accused persons. It is next submitted that the allegation against the petitioner is false. It is then submitted that the petitioner is not named in the FIR but without putting him under T.I. Parade as mentioned in para-2 of the supplementary affidavit dated 18.06.2026, charge sheet has been submitted against the petitioner; on the basis of the name of the petitioner being taken by the informant in his restatement made before police, during the investigation of the case. It is further submitted by drawing attention of this Court to the deposition of the victim Dinesh Mandal in S.T. Case No. 558 of 2025 faced by the co-accused persons Shakti and Suresh, that in para-10, he has categorically stated that he has not stated before the police that the petitioner was also involved in the alleged occurrence nor he has stated anything to implicate the petitioner in the said case. It is next submitted that in para-7 in the said deposition of the informant as PW-5 in S.T. Case No. 558 of 2025
he had stated that it the time of occurrence besides Suresh and Shakti Mandal, 2-3 other persons were also there but he does not know their name. It is then submitted that the petitioner has been in custody since 14.02.2026 as is evident from para-11 of the instant bail application. It is lastly submitted that the petitioner undertakes to co- operate with the trial of the case and also undertakes not to annoy or disturb the witnesses of the case in any manner during the trial of the case. Hence, it is submitted that the petitioner be released on bail.
Learned counsel appearing for the State opposes the prayer for bail of the petitioner.
Considering the facts of this case, the above-named petitioner is
directed to be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate-1st Class, Giridih in connection with Ahilyapur P.S. Case No.25 of 2025 with the condition that he will co-operate with the trial of the case and furnish his mobile number and photocopy of the Aadhar Card in the court below with an undertaking that he will not change his mobile number during the trial of the case and he will not annoy or disturb the witnesses of the case in any manner during the trial of the case.
