Learned counsel for the petitioners seeks permission to withdraw the present petition with liberty to file an application for discharge raising all the contentions before the learned trial court.
2. Let the discharge application be filed.
3. Learned 7th Judicial Magistrate, Howrah is directed to afford hearing in accordance with law to both the parties and decide the application for discharge expeditiously in accordance with the law.
4. The prayer for withdrawal of the petition is allowed.
5. Liberty granted to raise all the contentions before the learned trial court which have been raised in the present petition.
6. Petition is disposed of.
7. However, it is made clear that this Court has not gone into the merits of the case and no expression made herein shall tantamount to be an expression on the merits of the case.
