The present application has been filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as the ‘BNSS’) seeking grant of regular bail to the applicant in FIR No. 837/2020 dated 25.09.2020, registered at Police Station Chhawla, District Dwarka, Delhi, for offences punishable under Sections 302 and 201 of the Indian Penal Code, 1860 (hereinafter referred to as the ‘IPC’). 3. Briefly stated, on 25.09.2020, the complainant Surendra Kumar noticed a foul smell and blood-like fluid emanating from a locked room occupied by the applicant at Qutub Vihar, Goyla Dairy, Delhi. Upon the room being opened by the police, the dead body of a woman, subsequently identified as Dishu Kumari, was found concealed inside the box of a bed. The applicant was arrested on 29.09.2020 and, upon completion of investigation, a charge- This is a digitally signed order. Charges under Sections 302 and 201 IPC were framed against him vide order dated 23.05.2022, and the matter is presently at the stage of prosecution evidence. 4. The Status Report has been handed over by the learned APP for the State today in court. Let the same be taken on record. 5. Learned counsel for the applicant submits that the applicant has been in judicial custody since 29.09.2020. He further submits that, out of 46 witnesses cited by the prosecution, 35 witnesses have already been examined and that, during the last two years, only three to four witnesses have been examined. 6. It is also submitted that the applicant has a seven-year-old child and a wife to support and that he has been granted interim bail on about five occasions by the learned Trial Court, has never misused the liberty so granted, and has surrendered within time on each occasion. It is further submitted that all the public witnesses have already been examined. 7. Per contra, learned APP for the State submits that the case is based on circumstantial evidence and that, after allegedly committing the murder of his girlfriend, the applicant left her body in the room occupied by him as a tenant, where she used to visit, and thereafter fled from the spot. It is submitted that the body was subsequently recovered from the said room. 8. Having regard to the nature of the allegations and the gravity of the offence alleged to have been committed by the applicant, this Court finds no ground to grant regular bail to him. 9. Therefore, the present bail application is dismissed and is accordingly, disposed of. 10. Pending application(s), if any, also stand(s) disposed of. This is a digitally signed order.
