The writ application has been preferred praying for direction upon the respondent no. 2 to cancel the order dated 21.11.2025. 3. Vide the impugned order, it appears that the learned Judge, 2nd Labour Court, Kolkata rejected an application filed by the petitioner herein praying for setting aside of an order dated 10.03.2022. 4. It appears from the said order that vide the order dated 10.03.2022, the opposite party no. 3/petitioner’s “evidence was closed”, considering the conduct of the opposite party no. 3/petitioner herein. 5. It has been noted by the Labour Court that several opportunities were granted to the opposite party no. 3/petitioner herein, even to file a show-cause, which the petitioner failed to do and, as such, the Court recording a 2 reasoned order, has rejected the prayer of the opposite party no. 3/petitioner herein. 6. It appears from the said order that the conduct of the opposite party no. 3/petitioner herein is not good before the Labour Court but in the interest of justice, one last opportunity is to be granted to the said opposite party no. 3/petitioner herein. 7. Accordingly, the order no. 110 dated 10.03.2022 is set aside with a cost of Rs.10,000/- to be paid to the private respondent no. 3 herein. The petitioner here as opposite party no. 3 before the Labour Court, shall adduce evidence as directed by the Labour Court, without asking for any adjournment or any accommodation. There shall also not be any laches/delay on the part of the petitioner herein. 8. The learned Judge, 2nd Labour Court, Kolkata, shall proceed with the hearing of the case expeditiously, without granting any adjournment to either sides and make all endeavour to dispose of the proceeding before it, preferably within three months after process of SIR is complete, in case the officer concerned is engaged in the said process. And if not, then shall dispose of the same within three months from the date of this order. 3 9. Writ application stands disposed of. 10.
