1. This writ petition seeks the following relief:
“(a) Issue a writ of Mandamus ordering and directing the Respondent to fix notional pay of the Members of the Petitioner’s association from their respective date of joining for the purposes of Pension and consequently revise pension and all retiral benefits. (b) Issue a writ of Mandamus ordering and directing the Respondent to grant pension to all the members of the Petitioner’s Association on the basis of their respective date(s) of joining; (c) Issue a writ of Mandamus ordering and directing the Respondent to grant difference in pension to all the members This is a digitally signed order. of the Petitioner’s Association, as they are receiving deficient pension on the basis of date of regularization (01/01/2009) and not on their respective date(s) of joining”

At the outset, counsel for the Respondents objects to the maintainability of the present petition on the ground that the dispute raised herein pertains to service and pensionary benefits of employees of the Government of NCT of Delhi, which falls within the jurisdiction of the Central Administrative Tribunal under Section 14 of the Administrative Tribunals Act, 1985. It is submitted that, in view of the judgment of the Supreme Court in L. Chandra Kumar v. Union of India & Ors.,1 the Petitioner, having an efficacious alternative remedy before the Central Administrative Tribunal, cannot invoke the writ jurisdiction of this Court.
3. In view of the above, counsel for the Petitioner Association seeks leave to withdraw the present petition with liberty to approach the Central Administrative Tribunal, in accordance with law. He further requests that, having regard to the nature of the grievance raised in the present petition, the matter may be listed before the Central Administrative Tribunal at the earliest, if possible.
4. Leave and liberty, as prayed for, are granted. The Registry of the Central Administrative Tribunal is directed to place a copy of the present
order before the concerned authority of the Central Administrative Tribunal, for consideration of listing of the matter at the earliest, in accordance with its rules and procedure.
5. The Court has not commented on the merits of the case. All rights and
contentions of the parties are left open.
