03/24.06.2026 Heard learned counsel appearing for the petitioner and learned counsel appearing for the State.
2. The petitioner is apprehending his arrest in connection with Tandwa P.S. Case No.52 of 2022 dated 06.03.2022, registered for the offence under Sections 379, 411/34 of the Indian Penal Code and Section 30 of the Coal Mines Act, pending in the Court of the learned Judicial Magistrate, 1st Class, Chatra.

Learned counsel appearing for the petitioner submits that the allegations are made that on the motorcycle of the petitioner, 50 Kgs coal was being carried. He further submits that the co-accused persons have been granted anticipatory bail in A.B.A. Nos.3662 of 2022, 3762 of 2022, 4187 of 2022, 7304 of 2023 and 7526 of 2025. He next submits that the petitioner is having no criminal antecedent, as disclosed in paragraph 19 of this application.

Learned counsel appearing for the State opposed the prayer and submits that the petitioner was illegally carrying coal on the motorcycle.
5. Considering that the co-accused persons have been granted anticipatory bail in the aforesaid A.B.As. in identical situation and the petitioner is having no criminal antecedent, as disclosed in paragraph 19 of

this application and in the attending facts and circumstances of the case, I am inclined to extend the privilege of anticipatory bail to the petitioner.

Accordingly, the above-named petitioner is directed to surrender before the learned Court within three weeks from today and in the event of his arrest or surrender, he shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Chatra in connection with Tandwa P.S. Case No.52 of 2022, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
