Learned advocate appearing for the petitioner submits that the subject matter of recovery in the present case is 20.800 Kgs. of Ganja and the petitioner is in custody for more than a year. The petitioner has no criminal antecedents and the prosecution has relied upon 10 witnesses in order to prove its case.
Learned DSGI opposes the prayer for bail.
Having regard to the quantum of recovery, period of detention and the fact that the evidence of the 10 witnesses will
2 consume some time, I am inclined to release the petitioner on bail.
As such, the prayer for bail of the petitioner is allowed. Accordingly, Petitioner, namely, Md. Sadre @ Alam shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each. One of whom must be local to the satisfaction of Learned Special Judge, Special Court under NDPS Act, Kolkata. If on bail, petitioner shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District of Kolkata without the prior permission of the learned Special Court.
The petitioner shall meet with the Investigating Officer or any officer deputed by the Superintendent of Police, Narcotic Control Bureau once in every 10 days.
Accordingly, CRM (NDPS) 676 of 2026 is allowed.
All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
