JUSTICE H.P.SANDESH) This Writ Petition (Habeas Corpus) is filed under Articles 226 and 227 of the Constitution of India, by the petitioner praying to issue writ in the nature of habeus corpus or any other writ directing respondent Nos.2 and 3 to produce Ms.Kajal A Rajpurohit, daughter of Ashok Kumar. Learned HCGP appearing for the State submits that this is nothing but an abuse of process and the very Ms.Kajal A Rajpurohit, wrote a letter seeking protection for her safety to the police on 13.05.2026. Apart from that, learned counsel also placed a copy of the Order passed by this court in WP.No.11960/2026 and order was passed on 15.04.2026. The complaint 08.04.2026 was also given to the Station House Officer by the daughter and petitioner. When such material is placed before this court, it is nothing but an abuse of process by the petitioner by filing a writ of habeas corpus, as she went on her own since she is aged about 25 years. It is also submitted that the daughter of the petitioner left the house on 06.04.2026 and immediately on 08.04.2026 itself, daughter had filed complaint to the police against the petitioner. The present petition is filed for habeas purpose on 12.05.2026, almost 1 month 6 days, since she left the house on 06.04.2026 itself and it is nothing but an abuse of process, invoking the writ jurisdiction to direct respondent nos. 2 and 3 to produce her. - 4 - HC-KAR NC: 2026:KHC:24724-DB WPHC No. 53 of 2026 Hence, having considered the material on record, petition is dismissed with the cost of Rs.10,000/- payable before the Registry within one week from today by the petitioner.
