The present bail application has been filed by the applicant under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as ‘BNSS’) seeking regular bail in FIR No. 515/2025 for the offences punishable under Section 103(1), 3(5), 249, 61(2) of Bharatiya Nyaya Sanhita, 2023 (hereinafter referred to as ‘BNS’) registered at Police Station – Kalkaji, Delhi.

Learned counsel for the applicant submits that there are a total of 15 accused persons in the present FIR and, out of the 15 accused persons, 10 have already been granted bail by this Court. Therefore, on the ground of parity, he is seeking bail for the present applicant as well. 4. He submits that there is no specific role attributed to the applicant, This is a digitally signed order. Per contra, learned counsel for the complainant submits that, in the statement given by the public witness, Sumeet, the role of the applicant has been clearly described and that the applicant, along with the other co-accused persons, also gave beatings to the deceased, which resulted in his death. 6. Learned APP for the State fairly concedes that the applicant was holding a stick (danda) in his hand and that, as per the CCTV footage, it is clearly seen that someone took the said stick (danda) from his hand, following which the applicant left the spot. 7. In the facts and circumstances of the case, since the other co-accused persons have already been granted bail, and the role attributed to the applicant is that he was holding a stick (danda) in his hand, which was subsequently taken by the other co-accused persons, following which he left the spot, let the applicant be released on regular bail upon furnishing a bail bond in the sum of Rs. 25,000/- with two sureties of the like amount, to the satisfaction of the learned Trial Court, subject to the following conditions: i. The applicant shall not leave India without prior permission of the learned Trial Court. ii. The applicant shall intimate the learned Trial Court by way of an affidavit and to the Investigating Officer regarding any change in residential address. iii. The applicant shall appear before the learned Trial Court as and when the matter is taken up for hearing. iv. The applicant is directed to give his mobile number to the Investigating Officer and keep it operational at all times. v.
