Learned counsel for the Applicant submits that the chargesheet has been filed and charges have been framed, but there are 32 witnesses in the present case and not a single witness has been examined by the learned Trial Court till date and the trial is likely to take time. He further submits that there is no role attributed to the Applicant and no recovery was effected at his instance.

Learned counsel for the Applicant further submits that a co-accused has been released on bail by a Coordinate Bench of this Court vide order dated 10.07.2026 and therefore, on the ground of parity, the Applicant be released on bail. He further submits that the timings of the recovery and the arrest of the Applicant do not tally and, therefore, he be released on regular bail. This is a digitally signed order. Per contra, learned APP for the State submits that there is CCTV footage against the present Applicant and the specific allegation against him is that he inflicted repeated knife blows upon the deceased. The deceased sustained as many as 14 injuries. The witnesses are yet to be examined and all the eye-witnesses are living in the same vicinity where the Applicant resides. 5. Heard learned counsel for the Applicant and learned APP for the State. 6. So far as the ground of parity is concerned, in the order dated 10.07.2026, a Coordinate Bench of this Court has already recorded that the actual assault upon the deceased was attributed to the present Applicant and co-accused, who allegedly inflicted multiple knife blows upon the deceased. 7. Moreover, though the chargesheet stands filed, the fact remains that the eye witnesses are yet to be examined by the learned Trial Court and all the eye witnesses are stated to be residing in the vicinity where the Applicant resides. The specific role attributed to the Applicant is of having inflicted repeated knife blows upon the deceased, who sustained as many as 14 injuries. 8. No ground for grant of bail is made out. The present bail application is dismissed. Pending application(s), if any, also stand disposed of. 9. Needless to state, nothing stated hereinabove shall be construed as an expression of opinion on the merits of the case, and the observations made herein are confined to the consideration of the present bail application. 10.
