3. Petitioner has sought quashing of the FIR No.15 of 2026 dated 10.01.2026 under Section 316(2) of BNS, registered at Police Station Pathri, District Haridwar.
4. Counsel for the State has made a statement that since the offence is punishable for imprisonment of less than seven years, therefore, it is squarely covered by the judgment of the Hon’ble Supreme Court in the case of Arnesh Kumar vs. State of Bihar and another;
(2014) 8 SCC 273.
5. In such view of the matter, the writ petition stands disposed of in the light of the observation of the Hon’ble Supreme Court in the case of Arnesh Kumar (Supra).
