It is the submission of the applicant that this Court vide order dated 20.11.2023 passed in the Main case i.e. WP(C) No. 425 of 2022 has closed the opportunity for filing the counter affidavit by such respondent. This has caused prejudice to the case of the respondent/applicant herein and as such, prayer is made in this petition to modify the said order and to allow the applicant/ respondent herein to file their counter affidavit. There is no strong opposition to this prayer by the petitioner or any of the respondent herein, for end of justice, this Court is of the considered opinion that the prayer made be allowed. Accordingly, this petition is hereby allowed. The order dated 10. 07. 2023 is hereby modified to the extent that it shall now be relevantly read as “Filing of Counter Affidavit on behalf of the respondent Nos. 6 & 7 is allowed”. Let the said counter affidavit be filed definitely within the next date fixed. Petition is disposed of.
