Order 12/02/2026
1. In this batch of contempt petitions, issue of disobedience is identical in nature, hence, all contempt petitions were tagged and have been heard together as also would stand decided by this common order. 2. Petitioners do not dispute that notional fixation of pay after granting Annual Grade Increment w.e.f. 1st July has been done by the State Government but since the benefits of revised pension has been given w.e.f. 11.04.2023, the claim of petitioners is that they are entitled for revised pension, from the year, in which they stood retire. In addition, petitioners have also raised grievance that the other consequential benefits have not been paid. 3. Counsel for respondents-contemnors pointed out that the issue that the government servant who get retire on 30th June, shall be entitled for the Annual Grade Increment payable on 1st July, came at rest and attained finality after passing the judgment by the Hon’ble Supreme Court in Civil Appeal No.2471 of 2023 @ SLP (C) No.6185 of 2020; the Director (Admn. and HR) KPTCL & Ors. Vs. C.P. Mundinamani & Ors., decided on 11.04.2023,
[2026:RJ-JP:6747-DB] (8 of 9) [CCP-455/2024] hence, thereafter, Finance Department passed order dated 31.05.2024, to award monetary benefits of revised pension, after grant of Annual Grade Increment on 1st July, w.e.f. 11.04.2023. 4. It has further been pointed out that vide subsequent order dated 20.02.2025, passed by the Hon’ble Supreme Court in Misc. Application Diary No. 2400 of 2024 in Civil Appeal No.3933 of 2023 along with connected matters, it was made clear that the benefits of revised pension, in furtherance to the judgment dated 11.04.2023 will be given effect to, taking into account one increment payable on and after 01.05.2023. It was made clear therein by the Hon’ble Supreme Court that the enhanced pension for the period prior to 31.04.2023 will not be paid. 5. The contention of counsel for respondents-contemnors is that as per the order of the Hon’ble Supreme Court dated 20.02.2025, no government employee is entitled for enhanced pension, after his fixation of pay granting Annual Grade Increment on 1st July, prior to the period 31st April, 2023. Hence in that view, the revised pension paid to the petitioners w.e.f. 11.04.2023, may not be said to be in disregard to the orders of the High Court, rather same stands in coherence with the subsequent order of the Hon’ble Supreme Court dated 20.02.2025.
His further contention is that there is no specific order for any payment of consequential monetary benefits. 6. Taking into consideration the order of the Hon’ble Supreme Court dated 20.02.2025 (supra), we do not find that the order of State Government dated 31.05.2024, fixing the cut-off date i.e. 11.04.2023 for grant of benefits of pension after fixing the notional pay on grant of Annual Grade Increment w.e.f. 1st July to
[2026:RJ-JP:6747-DB] (9 of 9) [CCP-455/2024] the employees retired on 30th June, can be held as contumacious much less deliberate or willful, to the directions of this Court. 7. In respect of non-payment of other consequential benefits,
order is not clear that such consequential benefits includes the monetary benefits.
8. Accordingly, no case of contempt much less deliberate or willful, is made out.
9. Hence, these contempt petitions are hereby dismissed.
10. Notices of contempt stand discharged.
