The present petition has been filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, seeking quashing of FIR No. 541/2024 dated 04.09.2024, registered at Police Station Seemapuri, Delhi, for offences punishable under Sections 498A/34 of the Indian Penal Code, 1860 (hereinafter referred to as the ‘IPC’), and all consequential proceedings emanating therefrom, including Criminal Case No. MC/71/2025 pending before the learned JMFC (Mahila Court-02), Shahdara District, Karkardooma Courts, Delhi.

5. The brief facts of the case are that the marriage between Petitioner No. 1 and Respondent No. 2 was solemnized on 21.02.2011 according to Hindu rites and ceremonies. Three children were born from the said wedlock. Owing to certain disputes and differences, the parties started residing separately from
09.11.2023. On the complaint of Respondent No. 2, FIR No. 541/2024 dated 04.09.2024 was registered at Police Station Seemapuri, Delhi, under Sections 498A/34 IPC, and the consequential criminal proceedings are pending before the learned Trial Court.

Learned counsel for the petitioners submits that the parties have amicably resolved all their matrimonial disputes vide Settlement Agreement dated 29.07.2026. He further submits that Petitioner No. 1 and Respondent No. 2 have resumed their matrimonial relationship and have been residing together as husband and wife. It is submitted that Petitioner No. 1 has also been regularly providing maintenance of Rs.15,000/- per month to Respondent No. 2 and the children. He further submits that the parties have agreed to continue living together as husband and wife and to jointly take care of the children. It is submitted that nothing further survives between the parties. 7. On a query made by this Court, Respondent No. 2 categorically states that she has entered into the settlement out of her own free will, without any force, coercion or undue influence. She further states that she has resumed cohabitation with Petitioner No. 1 since February 2025 and has no objection if the present FIR and all consequential proceedings arising therefrom are quashed. 8. matrimonial disputes, resumed cohabitation and are living together, no useful purpose would be served by continuing the criminal proceedings. Rather, continuation thereof would only result in unnecessary litigation between the parties. There is no legal impediment to quashing the FIR in the facts and circumstances of the present case. 9. Accordingly, FIR No. 541/2024, registered at Police Station Seemapuri, Delhi, under Sections 498A/34 IPC, and all consequential proceedings emanating therefrom, including Criminal Case No. MC/71/2025 pending before the learned JMFC (Mahila Court-02), Shahdara District, Karkardooma Courts, Delhi, are hereby quashed qua the petitioners. 10. The present petition stands disposed of. 11. Pending application, if any, also stands disposed of. 12. A copy of this order be communicated to the concerned Trial Court for information and necessary compliance. 13. The order be uploaded on the website forthwith.
