Hon'ble Shri Justice Parth Prateem Sahu Order on Board 27.02.2026 1. The Petitioner has filed this Petition for the following reliefs:- “10.1 That, this Hon'ble Court may kindly be pleased to issue a writ of mandamus directing respondents to declare petitioners as temporary members of the Work- Charged/Contingency establishment effective from the day following completion of 3 years of service and declare them permanent members upon completion of 10 years. 10.2 That, this Hon'ble Court may kindly be pleased to issue a writ of mandamus directing respondents to grant the same 8 benefit to the petitioner as it was granted to 108 peons vide order dated 19.01.2022 (Annexure P-3). 10.3 That, this Hon'ble Court may kindly be pleased to issue a writ of mandamus directing respondents to appoint the petitioners as Work-Charged/Contingency establishment and fix and grant pay scale of Rs.4750-7440 + GP Rs.1300 (or equivalent revised Pay Band Level-01: Rs.15600-49400) per CG Work-Charged & Contingency Employee Pay Revision Rules, 2017, with all allowances, from the due dates. 10.4 That, this Hon'ble Court may kindly be pleased to issue a writ of mandamus directing respondents to pay arrears of salary difference with interest e.g. 9% p.a. from respective eligibility dates till payment. 10.5 That, this Hon'ble Court may kindly be pleased to issue a writ of mandamus directing respondents to consider the representation dated 01.04.2024 (Annexure P-4) within a time-bound period. 10.6 That, this Hon'ble Court may kindly be pleased to deice the representation of the petitioner the case of similarly situated candidates whose writ petition have been decided by this Hon'ble Court in a stipulated time. 10.7 That, this Hon'ble Court may kindly be pleased to grant any other relief/relief's in favour of the petitioner, which the Hon'ble Court deemed fit & just in the facts and circumstances of the case.” 2. Learned counsel for Petitioners submits that Petitioners were initially employed as daily wage employee and pursuant to the notification issued by the erstwhile State of Madhya Pradesh and State of Chhattisgarh, Petitioners have submitted representation on 9 01.04.2024 (Annexure P-4) before Respondent No.1 for fixation of regular pay, which till date is pending consideration, therefore, direction be issued to Respondent No.1 to take decision on the representation submitted by Petitioners at the earliest, within specified time frame. 3. Learned State Counsel submits that in view of the limited prayer made by leaned Counsel for Petitioners, he is having no objection. 4. On due consideration of the submissions made by learned Counsel for parties and looking to the nature of grievance raised, it is directed that Respondent No.1 shall take decision on the pending representation (Annexure P-4) submitted by Petitioners in accordance with law, expeditiously, preferably within further period of six months from the date of receipt of this order. 5.
