ARAVIND ORAL ORDER This petition is filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short, 'BNSS') by the accused in Crime No.336/2025 dated 01.10.2025, registered by the Vidyaranyapura Police Station, Bengaluru City for the offences under Section 352, 69 of Bharatiya Nyaya Sanhita, 2023 (for short, 'BNS') seeking enlargement on bail. 2. The petitioner, who is arraigned as an accused in Crime No.336/2025 for the offences punishable under Sections 352 and 69 of the BNS, is before this Court seeking grant of bail. 3. The complaint came to be lodged against the petitioner/accused alleging that he had established a physical relationship with the complainant on the false promise of marrying her and had also taken a sum of Rs.5,00,000/- from her. The complainant is stated to be working as a teacher in a public school. 4. Learned counsel for the petitioner submits that the relationship between the petitioner and the complainant was - 3 - HC-KAR NC: 2026:KHC:24810 CRL.P No. 5669 of 2026 consensual and that no force was involved. It is further submitted that the complainant, aged about 30 years, is working as a teacher. Learned counsel further contends that the allegation regarding demand of Rs.5,00,000/- by the petitioner is false. 5. Learned High Court Government Pleader appearing for the respondent-State submits that the petitioner entered into a relationship with the complainant by representing that he was unmarried and by promising to marry her. It is further submitted that, during the course of their relationship, the petitioner had taken a sum of Rs.5,00,000/- from the complainant. 6. Having considered the submissions made by the learned counsel for the petitioner and the learned HCGP, prima facie, it appears that the petitioner and the complainant were in a consensual relationship. The complainant, being aged about 30 years, is sufficiently mature to understand and decide the course of such relationship. It is also borne out from the record that the petitioner is a married person. In that context, prima facie, the allegation that the relationship was established on the - 4 - HC-KAR NC: 2026:KHC:24810 CRL.P No. 5669 of 2026 false promise of marriage appears to be doubtful. The allegation regarding receipt of Rs.5,00,000/- by the petitioner does not appear to have any direct nexus with the alleged offence. 7. In the light of the above, the following: ORDER (i) The Criminal Petition is allowed. (ii) The petitioner is directed to be enlarged on bail in Crime No.336/2025 registered by Vidyaranyapura Police Station for the offences punishable under Sections 352 and 69 of the Bharatiya Nyaya Sanhita, 2023, subject to the following conditions: a) The petitioner shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the like sum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all dates of hearing before the Trial Court unless exempted by the Trial Court for valid reasons; - 5 - HC-KAR NC: 2026:KHC:24810 CRL.P No. 5669 of 2026 c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve himself in any offences in future.
