By the present Petition, the Petitioner has challenged the issuance of process by the learned JMFC in a dispute arising out of Section 138 of the Negotiable Instruments Act. Admittedly, the accused has passed away. 3. In view thereof, the learned Counsels for the parties jointly submit that the parties would like to explore the dispute amicably. 4. In view thereof, the parties requested that a Mediator be appointed to resolve the dispute arising out of and related to the proceedings under Section 138 of the NIA. 5. Hence by consent: a) Mr Jatin Ramaiya, Advocate, is appointed as Mediator to mediate the disputes and differences between the parties arising out of, under and related to the Agreement dated 11th November 2014. The parties also agree and undertake that, if directed by the Learned Mediator, they shall deposit fees in advance. d) The mediation shall be completed on or before 30th November 2026 irrespective of whether the parties arrive at a settlement or not. e) The first meeting of the mediation will be held within one week from today, to be directed by the Learned Mediator. 6.
