Common Order:-
The petitioner in W.P.No.3384 of 2013 and the petitioner in W.P.No.3386 of 2013 have filed the writ petitions seeking to declare the action of the 1st respondent in not including the petitioner’s name in the eligible list for providing employment to displaced families under the NSRS Project, Srisailam. 2. It is submitted that the respondents initially included the petitioner’s name in the seniority list prepared for considering providing employment.
It is further submitted that subsequently, the 1st respondent rejected the case of the petitioner on the premise that the petitioner is not entitled to claim the benefit of G.O.Ms.No.98. The petitioner is the grandchild of the originally displaced family and, as such, the petitioner’s case was not considered by the respondents for providing employment in terms of G.O.Ms.No.98, dated
15.04.1986. 3. The learned Assistant Government Pleader appearing for the respondents submits that the petitioner, being a grandchild, cannot claim the benefit of G.O.Ms.No.98, as the said G.O. specifically refers only to the displaced person or his/her son, daughter or spouse, there being no other earning member in the family. It is submitted that a grandchild does not find place in the said G.O. and, as such, the petitioner is not entitled to claim employment by referring to G.O.Ms.No.98. 5
4. It is further submitted that the Hon’ble Division Bench of this Court in the matter of Chief Engineer, APGENCO, KTPS, Paloncha, Khammam District and two others v. S.K. Nazar1, has held that a grandchild is not entitled to employment under G.O.Ms.No.98. Following the same, admittedly, the petitioner is a grandchild of the displaced family and, as such, cannot be considered for providing employment in pursuance of G.O.Ms.No.98. 5. On these considerations, no further adjudication on merits is required. 6. Accordingly, these writ petitions are dismissed. There shall be no order as to costs. As a sequel, miscellaneous petitions pending, if any, shall stand closed. ____________________ JUSTICE HARINATH.N
