The present petition has been filed under Article 226 and 227 of the Constitution of India read with Section 151 of the Code of Civil Procedure, 1908 seeking following reliefs: “A. Issue an appropriate writ, order or direction directing Respondent No.1/learned Debts Recovery Tribunal-I, Delhi, to take up and consider/hear the pending Interim Application filed by the Petitioners in S.A. No. 210/2026 on an urgent basis and, preferably, before the scheduled auction dated 21.08.2026; B. Pending such consideration by the learned DRT, restrain Respondent No.2/Punjab & Sind Bank, its officers, agents and representatives from conducting, concluding, confirming or giving effect to the proposed auction of the secured assets which are the subject matter of S.A. Pass any other and further order(s) as this Hon’ble Court may deem fit and proper in the facts and the circumstances of the present case.” 2. Learned counsel appearing for the petitioner submits that the auction, which was scheduled to be conducted by the Bank on the last date fixed i.e. 21.08.2026, could not take place. In view thereof, he submits that the present writ petition has been rendered infructuous and seeks permission to withdraw the same, with liberty to the petitioner to raise all such contentions and avail of such appropriate remedies/proceedings as may be available to it in accordance with law, at an appropriate stage. 3. In view of the aforesaid submission, the petitioner is permitted to withdraw the present petition, with the liberty as prayed for. The present petition is, accordingly, dismissed as withdrawn. 4.
