The present application has been filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as the ‘BNSS’) read with Section 528 thereof, seeking interim bail on medical grounds in FIR No. 549/2017, registered at Police Station New Usmanpur, for the offences punishable under Sections 302, 120B and 34 of the Indian Penal Code, 1860 (hereinafter referred to as the ‘IPC’) read with Section 27 of the Arms Act, 1959. 3. Learned APP for the State has handed over the Status Report in Court today. Let the same be taken on record. 4. As per the Status Report, the medical documents have been verified and the doctor has further opined that surgery is required for removal of the stent under anaesthesia in the operation theatre. 5. The Applicant shall be released upon furnishing a bail bond for a sum of Rs. 10,000/-, with a surety of the like amount, to the satisfaction of the learned Trial Court. ii. The Applicant shall furnish his mobile number to the Investigating Officer/SHO concerned and shall keep the same operational at all times during the period of interim bail. iii. The Applicant shall not directly or indirectly contact, influence, induce, threaten or intimidate any prosecution witness or tamper with the evidence in any manner. iv. The Applicant shall intimate the Investigating Officer/SHO concerned about any change in his residential address or contact details forthwith. v. The Applicant shall not indulge in any criminal activity and, upon his indulging in any such activity, the present interim bail shall automatically stand cancelled. vi. The Applicant shall not leave the country without the prior permission of the learned Trial Court. vii. Upon the expiry of the period of interim bail, the Applicant shall surrender before the concerned Jail Superintendent on the due date. 6. During the said period of one week, if the Applicant is able to produce documents regarding the date of his surgery, he shall be at liberty to move an appropriate application seeking further interim bail. 7.
