JUSTICE ANU SIVARAMAN) This Contempt of Court case is filed alleging non- compliance of the order of the learned Single Judge dated 08.11.2022 in W.P.No.5769/2022. 2. We have learned the learned counsel appearing on either side. 3. The order passed by learned Single Judge reads as follows: "2. Learned AGA appearing for the Respondents though initially oppose the petition, now graciously agrees to instruct his client to look into the grievance of the Petitioner. It is un-understandable as to how the entries are not restored despite there being a Writ Appeal order. Such things would not have happened even during the regime of Muhammad Bin Tughlaq, to say the least. In the above circumstances, the petition is disposed off on the assurance of the. learned AGA. The period for compliance is sixty days and the Deputy Commissioner shall report to the Registry of this Court the restoration of entries in favour of the Petitioner in terms of Writ Appeal judgment, failing which, heavy costs may be personally payable by the Deputy Commissioner." - 4 - HC-KAR NC: 2026:KHC:13609-DB CCC No. 403 of 2023 4. The accused are present before the Court today. An affidavit filed by the learned Additional Government Advocate appearing for the accused is placed on record. Paragraphs No.6 to 9 of the affidavit reads as under: "6. I state that when the W.P.No.14871/2013 (KLR-RR/SUR) filed by the complainant was pending before this Hon'ble Court, the Regional Commissioner, Bengaluru issued a circular dated 12.11.2019 with regard to correction of the RTC, Darkasth Podi et copy of the said circular dated 12.11.2019 is produced herewith and marked as Annexure-R1. As per the directions contained in the said circular, the hissas in RTC pertaining to Sy.No.43 or Doddajala Village, Jala Hobli, Yelahanka Taluk have been amalgamated and hence, the earlier hissa No.16 of Sy.No.43 ceased to exist. But single RTC is made for entire Sy.No.43 by including all the lands with total extent of 19 acres 10 guntas. In the said single RTC pertaining to Sy.No.43 the name of the complainant is entered in so far as his 2 acres of land is concerned. The copy of the present RTC of Sy.No.43 showing the name of complainant, is herewith produced as Annexure-R2. 7. I state that in view of circular dated 12.11.2019, the land of the Complainant is in existence as it stood as per the revenue records. However, the entire lands in the said Survey No.43 are grouped into a single holding and specifically there is no mention of individual holdings in individual RTC. 8. I state that after the procedure of grouping the lands, in terms of the circular dated 12.11.2019 there is no difference between the previous numbers and the present number in case of this complainant initially his - 5 - HC-KAR NC: 2026:KHC:13609-DB CCC No. 403 of 2023 land was reflected as Survey No. 43/16 and presently it's name and extent are shown in the single RTC sy No.43. However, this entry does not change the ownership or the Nature of possession of the property by the complainant. 9. I state that since the complainant's land was already converted considering the old number the said conversion order is not affected by grouping of lands as the old number (sy No.43/16) and present survey number (sy no.43) grouped as one, are one and the same. The conversion order and other records reflecting the complainant's land as Sy No.43/16 will not be affected by grouping of the lands and continue to be valid." 5. The affidavit is taken on record. There is no serious objection raised by the learned counsel appearing for the complainant. 6. In the above view of the matter, the Contempt of Court case is closed.
