Based on the above complaint accused herein and other accused were also arrested. Investigation is completed and the charge sheet is filed. - 4 - HC-KAR NC: 2026:KHC:22972 CRL.P No. 294 of 2026 4. Counsel for the petitioner submits that the age of the accused No.1 is 22 years, whereas age of the complainant is 38 years. He submits no prima facie case is made out against the accused of he or accused Nos.2 and 3 allegedly committing the offence at his instance. He submits that in the charge sheet the prosecution is not clear as to the place of incident. That it was a consensual act, inasmuch as, even according to the allegation in the complaint, they got acquainted over Instagram and she had come all the way from Maharashtra to Bengaluru. As such, the complaint averments do not make out a case of offence having been committed under Section 69 of the BNS, Act. He submits that the accused Nos.3 to 4 have already been released on bail. Since the charge sheet is filed there is no requirement of custodial interrogation of the accused. Therefore, seeks for grant of regular bail. 5. Learned Addl. SPP on the other hand opposing the petition submitted that during the investigation the prosecution has found and identified the place of offence and the owner of the place has been cited as a charge sheet witness. - 5 - HC-KAR NC: 2026:KHC:22972 CRL.P No. 294 of 2026 6. On a query by this Court, it is submitted that the complainant is a resident of Maharashtra and she can be kept present before the Court as and when required. It is further submitted that the accused-petitioner hails from Bihar and if he is let free on bail, it would be difficult to secure him for the trial. Hence, seeks for rejection of petition. 7. Heard. Perused the records. 8. Offence alleged is stated to have taken place between 26.03.2025 to 28.03.2025. Cause title of the petition indicate that petitioner is from Bihar. Complaint averments indicate that the victim is from Maharashtra. Even according to the complaint averments, the victim had voluntarily come from Maharastha to Bangalore on a purported promise of marriage and securing the job which allegedly misused by the accused- petitioner. The age of the petitioner herein is shown as 22 years while the age of the complainant is shown as 38 years. Whether he really promised to marry her as well as obtaining employment needs to be determined during the trial. Since charge sheet is already filed, considering the allegations made in the complaint as noted above, this Court deems it - 6 - HC-KAR NC: 2026:KHC:22972 CRL.P No. 294 of 2026 appropriate to grant the bail as sought for subject to following conditions; i. Criminal Petition is allowed. ii. The accused/petitioner is directed to be enlarged on bail in Crime No.117/2025 registered before the Yelahanka Police Station, Yelahanka Sub-division, Bangalore City for the offences punishable under Sections 69, 3(5) of BNS, Act, 2023 before, subject to the following conditions: a) the accused/petitioner shall execute personal bond for a sum of Rs.1,00,000/- with one local surety for the likesum, to the satisfaction of the jurisdictional Court; b) He shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) He shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) He shall not involve in similar offences in future; - 7 - HC-KAR NC: 2026:KHC:22972 CRL.P No. 294 of 2026 e) He shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
