907 CP 58 2026 9th October, 2026 vinita IN THE HIGH COURT OF BOMBAY AT GOA CONTEMPT PETITION NO.58 OF 2026 WITH CRIMINAL WRIT PETITION NO.322 OF 2026 CONTEMPT PETITION NO.58 OF 2026 ISHWARYA DAMODAR KAKULE ... PETITIONER Versus PARAM SHANTARAM ZANZAL ... RESPONDENT WITH CRIMINAL WRIT PETITION NO.322 OF 2026 ISHWARYA DAMODAR KAKULE ... PETITIONER Versus PARAM SHANTARAM ZANZAL ... RESPONDENT Ms Caroline Collasso, Advocate for the Petitioner. Ms A. Agni, Senior Advocate with Ms Anamika Rawool, Advocate for the Respondent. CORAM:- AMIT S. JAMSANDEKAR, J. DATED :- 9th October, 2026 P.C. 1. By the present petition, the Petitioner has alleged that the Respondent has committed contempt of this Court by willfully disobeying the order dated 18.8.2026. The dispute is matrimonial, in which the Petitioner and the Respondent are litigating for custody of a four-year-old minor child. Given the Respondent's disobedience, the Court passed a detailed order on 18.8.2026 in Criminal Writ Petition No. 322/2026. Apart from the other orders and directions, the Respondent was inter alia directed in paragraph (v)as “follows: 2026:BHC-GOA:2055 907 CP 58 2026 9th October, 2026 “During the pendency of the hearing and final disposal of the interim application before the learned JMFC, the Respondent is ordered and directed to give sole custody of the child to the Petitioner on every Thursday (beginning from 20.08.2026) at 4 p.m. until Monday at 10 a.m. On every Monday, the Respondent shall pick up the child from the residence of the Petitioner at 10 a.m. and drop the child back at the residence on every Thursday at 4 p.m.;” 2. Admittedly, the custody was not given as ordered in paragraph V of the order dated 18.8.2026. However, after hearing the contemnor and after directions were given in the present contempt petition, the Respondent has abided, and he continues to abide by the operative paragraph V of the order dated 18.8.2026. 3. This is a matrimonial dispute, and I have already expedited the proceedings pending before the trial Court. Mrs Agni, on behalf of the Respondent, submitted that the Respondent assures that he shall abide by the order of this Court and that this statement be recorded as his undertaking to this Court. 4. I had also directed the parties that they shall meet Counsellor Dr. Nandita De Souza, at SETHU. Consequent thereto, the Petitioner already had one session with SETHU. However, due to miscommunication, the Respondent has not visited SETHU. 5. In view thereof, on behalf of the husband, the learned Senior Counsel submits that the husband shall forthwith register with SETHU and shall 907 CP 58 2026 9th October, 2026 abide by the directions, SOP and directions/instructions which may be given by Dr. Nandita De Souza. 6. Dr. Nandita De Souza, is requested to meet the couple together or individually or along with the minor child as per the requirements which shall be followed by the Petitioner and the Respondent. 7. I am disposing of the present contempt petition in view of the statement made by the Petitioner that the order is being complied with by the Respondent and that the further undertaking of the Respondent that no breach or violation shall be committed by the Respondent. 8. I have been informed by the learned Senior Counsel that the trial Court proceedings are being conducted in accordance with the directions given in the order dated 18.8.2026 and slightly modified by further order passed in the present proceedings. 9. In view thereof, I do not find any reason to keep the contempt petition pending. Accordingly, the same is disposed of. The undertaking given by the Respondent is accepted as an undertaking to this Court. 10. The fees of SETHU shall be paid by the Respondent. 11. This order will be digitally signed by the Private Secretary/Personal Assistant of this Court. All concerned will act on production by fax or email of a digitally signed copy of this order. AMIT S.
