1. This revisional application has been filed praying for expeditious disposal of Matrimonial Suit No. 4 of 2017 as well as an application for amendment of plaint filed in connection therewith, which are pending before the learned Additional District Judge, (8th Court), Alipore, South 24 Parganas.
2. Learned advocate appearing for the petitioner’s submits that the suit is on the ex parte board. It is submitted that the application for amendment had been filed as per back as on November 01, 2022 but the same is yet to be disposed of. It is further submitted that despite the suit running ex parte, adjournment is being taken by the opposite party and the same is being liberally granted by the learned Trial Court.
3. Having regard to the nature of the order proposed to be passed, no direction for prior service of a copy of the revisional application along with notice on the opposite party is being passed. However, the
2 petitioner shall be obliged to serve a copy of the revisional application along with a copy of this order on the opposite party within a week from date.
4. Having heard the learned advocate appearing for the petitioner and having perused the material on record. This revisional application is disposed of by requesting the learned Trial Court to dispose of the petitioner’s application for amendment filed on November 01, 2022 within a month from the next date fixed without granting any unnecessary adjournment to either of the parties.
5. The learned Trial Court is also requested to endavour to dispose of the Matrimonial Suit being MAT Suit No. 04 of 2017 thereafter, expeditiously as possible, preferably within a period of one year from the date of disposal of the application for amendment without granting any unnecessary adjournment to either of the parties.
6. CO. 799 of 2026 stands disposed of.
7. Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
