02/ 22.06.2026: Heard learned counsel for the petitioner and learned counsel for the State.
2. The petitioner is apprehending his arrest in connection with Paton P.S. Case No. 83 of 2021, registered under sections 302, 120B/34 of I.P.C and section 27 of Arms Act, pending in the Court of learned Judicial Magistrate, Ist Class, Palamau at Daltonganj.

Learned counsel for the petitioner submits that the name of the petitioner has come in the confessional statement. He next submits that the petitioner has nothing to do with the said firing. He next submits that firing was made by Surendra Yadav and pursuant to that deceased has died. He submits that younger brother of Surendra Yadav was the roommate of this petitioner and once the mobile of this petitioner was used by younger brother of Surendra Yadav due to which the petitioner has been implicated in this case. He next submits that one of the co-accused in his statement under section 164 of Cr.P.C has not taken the name of the petitioner and petitioner has got no criminal antecedent which is disclosed in para 18 of the petition. On these grounds, he submits that the petitioner may kindly be provided privilege of anticipatory bail.

Learned counsel for the State opposes the prayer and submits

that the name of the petitioner has come in the confessional statement.

There is direct allegation of firing against Surendra Yadav and pursuant to that deceased has died. In para 154 of the case diary it has come that younger brother of Surendra Yadav has once used the mobile of this petitioner for communicating his family members and apart from that there is no allegation against the petitioner. Further one of the co-accused in his statement under section 164 of Cr.P.C has not taken the name of this petitioner and the petitioner has got no criminal antecedent which is disclosed in para 18 of the petition.

In the attending facts and circumstances of the case, I am inclined to grant anticipatory bail to the petitioner. Accordingly, the above named, petitioner is directed to surrender before the learned court within three weeks from today and in the event of his surrender / arrest, the petitioner shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each, to the satisfaction of learned Judicial Magistrate, Ist Class, Palamau at Daltonganj, in connection with Paton P.S. Case No. 83 of 2021, subject to conditions as laid down under Section 482 (2) of B.N.S.S, 2023.
