It is submitted that the Applicant has deposited the entire compensation amount, a part of which is deposited before the Appellate Court and the balance amount, the Applicant has directly paid to the Respondent. 3. The learned Counsel appearing for the Respondent confirms that the entire amount has been paid/deposited. He states that the Respondent has no objection for compounding the offence, subject to release of the deposited compensation amount in favour of the Respondent. 13th October, 2026 901 CRIR 15 2017 4. In view thereof, the judgment and order dated 07.10.2016 passed by the learned Judicial Magistrate First Class at Canacona in Criminal Case No. 16/NI/2016 and the judgment and order dated 28.02.2017 passed by the learned Sessions Judge in Criminal Appeal No. 92/2016 are quashed and set aside and the offence under Section 138 of the Negotiable Instruments Act, 1881 stands compounded. 5. The Superintendent of the Sessions Court at Margao is directed to remit the amount of Rs.1,97,500/- deposited by the Applicant along with accrued interest, if any, in favour of the Respondent on the following Bank Account:- Account No:- 50200035833244 IFSC:- HDFC0001262 Bank:- HDFC Bank, Canacona Account Holder:- Chetan Phaldessai 6. The Applicant shall pay Rs.10,000/- towards costs to the Goa State Legal Services Authority on or before 21.10.2026. 7. It is clarified that the relief granted in this Application will be operative only after payment of costs as stated above. 8. Criminal Revision Application No. 15 of 2017 stands 13th October, 2026 901 CRIR 15 2017 disposed of. 9. List the matter on 23.10.2026 for reporting compliance. 10.
