The petitioner is apprehending his arrest in connection with Nirsa PS Case No.614 of 2025, for offence registered under section 317(4), 317(5), 338, 336(3), 3(5) BNS, 2023 and section 21 of the Mines and Minerals (Development and Regulation) Act, 1957, Section 54 of Jharkhand Minor Mineral Concession Rules, 2004 and Rule 13 of Jharkhand Minerals (Prevention of Illegal Mining, Transportation and Storage) Rules, 2017, pending in court of learned Judicial Magistrate First Class, Dhanbad.

Learned counsel for petitioner submits that the petitioner has been falsely implicated in this case and only allegation is made against the petitioner that he used to help others in sending sand and two persons in identical situation have been granted anticipatory bail in A.B.A. No.1436 of 2025 and the owner has been granted anticipatory bail by this Court in ABA No.1436 of 2026.

4. Learned State counsel opposes prayer and submits that the name of the petitioner has come on confessional statement.

Considering that name of the petitioner has come on confessional statement and in identical situation the co-accused has been granted anticipatory bail as aforesaid, I am inclined to grant anticipatory bail to petitioner.

Accordingly, petitioner, above named, is hereby directed to surrender before learned court within three weeks from today, and in event of his surrender/arrest, petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of like amount each, to satisfaction of learned Judicial Magistrate First Class, Dhanbad, in connection with Nirsa PS Case No.614 of 2025, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
