In this writ petition the petitioners have made the following prayers: “i. For issuance of writ of the nature of Certiorari, for 2026:JHHC:18334 2 quashing of the order dt. 20.03.2020 (Annexure-2) passed in connection with Misc. Case NO. 06/2015-16 by Additional Collector, Garhwa whereby & whereunder direction was issued to Circle Officer, Garhwa and Land Record Deputy Collector, Garhwa to cancel the demand running in the name of the petitioner no.1 & Performa resp. No. 13 recorded at Page no. 172/3 & 173/3 of the demand register-II with respect to land having Khata No. 158, 84, 65, 41 and corresponding Plot numbers 262, 190, 279, 291, 284, 283, 285, 212 having total area of 17.17 ½ acres situated at Village-Sonpurwa, Thana No. 242, Circle & District- Garhwa. ii. For issuance of writ in the nature of mandamus, commanding the respondent No. 3 to 5 to restore the Jamabandi in favor of the petitioner with respect to above mentioned land. iii. For issuance of any other appropriate writs(s), order(s), direction(s) as this Hon'ble Court may deem fit and proper for grant of any other appropriate relief(s) to the petitioners under the facts and circumstances of this case.” 3. After hearing the parties, I find that there is serious disputed question of title involved in this case as the petitioner claims title through the sale deed but the Revenue Authorities while cancelling the Jamabandi has arrived at a finding that the land was gifted prior to sale to the petitioner. All the disputes with regard to title cannot be looked into in an application under Article 226 of the Constitution as it involves serious disputed question of facts. 4. Thus, this writ petition is disposed of with liberty to the petitioner to approach the appropriate Civil Court having competent jurisdiction by filing the suit impleading other private parties. The Civil Court will decide the right, title and interest of the land in question on its own merits. 5. The Revenue Authority is expected to abide by the order so passed by the Civil Court.
