AKOLA Office Notes, Office Memoranda of Coram, Appearances, Court's orders or directions and Registrar's orders Court's or Judge's orders Mr. R.S. Kalangiwale, Advocate for Applicants. Mr. N.B Jawade, APP for Non-Applicant-State.
CORAM : M.M. NERLIKAR, J.
DATED : 12th OCTOBER 2026 PER COURT :-
1. Heard learned Counsel for the applicants and learned APP for the State.
2. Apprehending arrest, the applicants have approached this Court under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, for grant of anticipatory bail, in connection with Crime No.408 of 2026, registered with Police Station Old City, Akola, for the offences punishable under Sections 314, 318(4) read with Section 3(5) of the Bharatiya Nyaya Sanhita, 2023 and Sections 3, 4 of the Maharashtra Protection of Interest of Depositors (in Financial Establishments) Act, 1999. 2026:BHC-NAG:13707

3. The FIR came to be lodged alleging that the applicants and other accused persons allegedly induced villagers for investing their money in various schemes by assuring them good returns on the investment, however, the same was not done and thereby, defrauding the victims for Rs.1,96,23,075/-.
4.
Learned Counsel for the applicants submits that the applicants are neither on the Board of Directors nor they have any connection with the alleged fraud. He submits that applicant No.1 is the sister of main accused Tushar Takzure and applicant No.2 is the husband of applicant No.1 (brother-in-law of accused Tushar). He submits that since Tushar started Takzure Urban Nidhi Ltd. Bank at Akola, he asked public and even the family members to invest amount in the said bank. Accordingly, the applicants invested Rs.18,90,000/- in the said bank, on which they had received returns like other investors. He submits that the applicants neither induced the public to invest in the said bank nor any fraud is committed by them. He submits that the main allegations are against Tushar Takzure and therefore, being his family members, even the applicants have been implicated in the crime. Therefore, the applicants deserve to be granted anticipatory bail. 3 13. ABA 820 of 2026.odt
5. On the other hand, learned APP invited my attention to the statements of victims, which goes to show that applicant No.2 along with Tushar and others, were inducing people to invest amount in the said bank. He submits that the total transaction between the applicants and the said bank is of more than Rs.21 Lakhs. He submits that all the family members of Tushar are instrumental in committing the crime. Considering the fraud, which is to the tune of Rs.1,96,23,075/-, the applicants do not deserve to be granted anticipatory bail. 6. Upon consideration of the submissions of both the sides, apparently, it appears that the main allegations are against Tushar Takzure. It further appears that the said bank i.e. Takzure Urban Nidhi Ltd. Bank at Akola was registered with Registrar of Companies. By way of said bank, several schemes were introduced like Annadata Scheme, Daily Collection Scheme, etc. Not only that, one TMT Group was also formed, for calling investment from different investors and it was assured that 10% interest per month would be paid on the invested amount. It further appears that all the family members of the main accused have been arraigned as accused in the crime as they have not only induced the public at large, but seems to have taken the meetings for the purpose of investment also. 4 13. ABA 820 of 2026.odt
7.
Upon perusal of the case diary as well as other material placed on record, it appears that both the applicants have invested Rs.18,90,000/- from 2020 till 2024 and had received Rs.21,21,800/-, as returns on the said amount from the bank. After perusal of the statements of the victims, it appears that applicant No.2 along with other co-accused were holding meetings and were persuading people for investing in the said bank on the basis that the investors will receive 10% interest per month on invested amount. Those statements refer the name of all co-accused stating that all have induced the investors, however, no specific inducement on the part of applicant No.2 is stated. So far as applicant No.1 is concerned, in the statements recorded by the Investigating Officer, her name does not appear stating that she was conducting the meetings and inducing public at large. So far as receiving an amount of Rs.21 Lakhs by the applicants from the bank is concerned, there is every possibility that being the family members and investment of near about Rs.19 Lakhs by the applicants, the priority was given to the applicants by returning the amount as the applicants are sister and brother-in-law of main accused Tushar. Therefore, considering the allegations, I am of the considered opinion that the applicants have made out a prima facie case for grant of anticipatory bail. Hence, the following order. 5 13. ABA 820 of 2026.odt
ORDER i) The Criminal Application is allowed and disposed of. ii) In the event of arrest, applicant No.1 viz. Trupti W/o. Rajesh Yelane and applicant No.2 viz.
