Learned High Court Government Pleader raises a preliminary objection that the petitioners are seeking to espouse a public cause while contending that the private respondents herein have encroached upon a part of the government property in Survey Nos. 573, 74 and 77 of Byaladakere Village, Agaturu Hobli, Maddur Taluk, Mandya District, and it is stated in the petition that the portions of the - 4 - HC-KAR NC: 2026:KHC:14706 WP No. 6870 of 2026 property encroached by the private respondents are "Halla and Katte". 3. Learned High Court Government Pleader is right in his submission. If the encroachment was on a public road, then the petitioners would be directly affected, if the ingress and egress to the property were blocked by way of an encroachment. However, the allegation in the petition is not such and the learned High Court Government Pleader is therefore right in his submission that the petitioners are seeking to raise and espouse a public cause. 4. Accordingly, the writ petition stands dismissed, while reserving liberty to the petitioners to file public interest litigation, if so advised.
