1. The instant Civil Miscellaneous Petition has been filed for restoration of writ petition being W.P.(S) No.1307 of 2018 which stood dismissed on 04.04.2023 due to non- compliance of the peremptory order dated 21.03.2023.
2. The reason assigned in the instant petition is that after the peremptory having been passed by this Court on 21.03.2023 granting two weeks’ time to remove the defect(s) as has been pointed out by the office but the fresh legible copy was not available with the department, therefore, one I.A. No. 3205 of 2023 was filed for ignoring the defect no.18 but the said interlocutory application could not be placed before the Bench within time, which resulted in dismissal of W.P.(S) No.1307 of 2018 due to non-compliance of the peremptory order dated 21.03.2023.
3. It has been submitted that the instant Civil Miscellaneous Petition has been filed for restoration of writ petition being W.P.(S) No.1307 of 2018 and if the same will not be restored, the petitioners will suffer irreparable loss and injury.

This Court, after having heard the learned counsel for the petitioner, considering the submissions advanced by him and the reason assigned in the instant Civil Miscellaneous Petition, is of the view that the instant petition is to be allowed otherwise the petitioners will suffer irreparable loss and injury since the matter would not be decided on merit.
5. Considering the same, this Court deems it fit and proper to restore the writ petition being W.P.(S) No.1307 of 2018 which stood dismissed on 04.04.2023 due to non- compliance of the peremptory order dated 21.03.2023, to its original file.
6. In view thereof, the writ petition being W.P.(S) No.1307 of 2018 is restored to its original file.
7. Accordingly, the instant Civil Miscellaneous Petition stands disposed of.
