Learned counsel for the petitioners submits that petitioners would be satisfied, in case direction is issued to competent authority to consider and decide their claim for grant of work-charge status and consequential benefits in terms of judgment dated 06.02.2025 passed by the Hon'ble Supreme Court in Civil Appeal No.1595 of 2025 arising out of SLP (C) No.23016 of 2023 titled as State of Himachal Pradesh & Ors. versus Surajmani & Anr. along with connected matters, without discriminating the petitioners being Nepali citizens.

Learned Additional Advocate General submits that after verification of facts, in case petitioners are found entitled to the benefits flowing from aforesaid judgment of the Hon'ble Supreme Court, the same shall be extended to them within the time granted by this Court.

In view of aforesaid submissions and without examining the merits of the case, present writ petition is disposed of with direction to respondent No.3/Competent Authority to consider and decide the claim of the petitioners in the light of the judgment passed in Surajmani’s case and shall not deny consideration on the ground that the petitioners are Nepali citizens. In case petitioners are found entitled, the consequential benefits shall also be extended to them. The entire exercise shall be completed on or before 15.10.2026 by passing a reasoned and speaking order after giving opportunity of hearing to the petitioners, if so desired. A copy of the order so passed shall also be communicated to the petitioners forthwith.

Petition stands disposed of in the above terms, so also the pending miscellaneous application(s), if any.
